Eli fake memorabilia lawsuit settled

A lawsuit claiming Eli Manning committed memorabilia fraud was settled on Tuesday. Details were not given.

When they left the courthouse before noon, there was little optimism from all parties involved that a settlement would soon be reached.

Attorneys in the four-year-old lawsuit against the New York Giants and Manning, the two-time Super Bowl MVP quarterback, arrived in a county courtroom in Hackensack on Monday prepared to deal with pre-trial motions ahead of jury selection, which had been scheduled to begin Wednesday with opening arguments slated for next Monday.

"The compromise agreement, entered into by all parties, should not be viewed as supporting any allegations, claims or defenses", Giants spokeswoman Karen Kessler said in a statement.

Three plaintiffs say they bought two of the allegedly fraudulent helmets from Steiner Sports, which has a contract with Manning to provide the game-used equipment. "All parties are grateful to have the matter, which began in 2014, concluded and are now focused on football, the fans and the future", the statement read.

His attorneys described the lawsuit as "inflammatory and baseless", while also claiming that the Inselberg's attorneys had used underhanded tactics to create negative press for Manning, according to ABC.com via the Associated Press' David Porter.

"I've never heard of that before litigation", he said. Inselberg says emails show Manning engaged in a pattern of deceiving collectors.

Filed four years ago by Eric Inselberg after an Federal Bureau of Investigation raid ruined his memorabilia business, the suit alleging that the Giants passed off phony helmets, including two Manning had supposedly worn in separate Super Bowl wins, had been slowly gaining steam. Inselberg alleged photographic experts, using a technique called "photomatching", could not find evidence that the helmets were ever used in games.

The lawsuit was originally filed in 2014, but things changed significantly in 2017 when Inselberg acquired emails between Manning and Giants equipment manager Joseph Skiba. Now that issue will not go before a jury, and Manning has put it behind him.

Manning and the team have denied the claims, and have characterized lead plaintiff Eric Inselberg as a scam artist who sold fake memorabilia himself over a span of several years. In a court filing this month, Manning's attorney wrote that the email was meant to ask Skiba for two game-used helmets that would "satisfy the requirement of being game-used".
